Naivasha MP Jayne Kihara released on Sh50,000 personal bond

Naivasha Member of Parliament (MP) Jayne Kihara was on Friday released on a personal bond of Sh50,000 after appearing in court over charges linked to alleged incitement.

However, she did not take a plea as the court has yet to determine whether the charges meet the legal threshold.

The matter is scheduled for mention on July 29, when the ruling on the legality of the charges will be delivered.

Kihara’s arrest on Thursday followed remarks she allegedly made during a political event. Her legal team argued in court that the charges were politically motivated and lacked substance, while the prosecution sought to block her release, a request that the court declined.

She was arrested at her home in Maraigushu, Naivasha, in an operation streamed live on her Facebook account.

A group of officers from the Directorate of Criminal Investigations (DCI), accompanied by local police, arrived at her residence in the afternoon, arrested her and took her to Naivasha Police Station.

Police had indicated that she would later be taken to the DCI headquarters in Nairobi for further questioning.

Speaking out after the arrest, Kihara said she had no knowledge of the matter she was being linked to and could not assist investigators

“They say they believe I have information that can help them. I can’t do that,” she said. Earlier, she had posted on Facebook: “Dozens of police officers are currently at my Maraigushu home to arrest me.”

Her arrest came shortly after she held a meeting with sand harvesters in Mai Mahiu, and days after she ignored a summons by the DCI to appear at their Nairobi offices.

The summons, dated Friday last week and signed by senior officer George Lenny Kisaka, accused her of spreading “inciteful or disruptive content” on social media.

She had been directed to present herself on Monday, July 14, at 10:30 am.

In response to the summons, Kihara maintained she was being targeted.

“The days of intimidating leaders using the criminal justice system are long gone. Summoning me to DCI headquarters tomorrow will not change Kenyans’ resolve, because this is not about Jayne Kihara but about our country, Kenya,” she posted online.

She has previously accused the government of using security agencies to intimidate leaders allied to former Deputy President, Rigathi Gachagua.

In May, she claimed her security was withdrawn without explanation, leaving her “vulnerable and naked,” and said the President would be held responsible for anything that might happen to her.

Her arrest sparked political condemnation, with Wiper Party leader Kalonzo Musyoka terming it politically driven. “This is clear political persecution. We will get Naivasha MP Jayne Kihara out!” he declared.
